All district councils in England have a responsibility to prepare a new development plan, called a Local Development Framework (LDF), for their areas under the Planning and Compulsory Purchase Act. The LDF sets out the planning framework for a district and guides decisions on planning applications. However local government reorganisation in Cheshire means that most of the LDF will now be taken forward for Cheshire West and Chester rather than for Ellesmere Port & Neston. The new authority comes into being on 1 April 2009. A Shadow Authority has been formed and is starting to shape how the LDF for Cheshire West and Chester will taken forward.
The first major task for Cheshire West and Chester will be to prepare a Core Strategy, although SPDs prepared by the existing authorities will become part of the LDF for the new authority. In addition it is likely that the Central Ellesmere Port Area Action Plan will be taken forward as a DPD within the Local Development Scheme for Cheshire West and Chester.
The draft Local Development Scheme for Cheshire West and Chester will be considered by the LDF Panel of the Shadow Authority on 5 November 2008.

The LDF will start to replace the policies of the existing adopted local plans in West Cheshire including the Ellesmere Port & Neston Local Plan which was adopted in 2002. The LDF is a portfolio of separate documents that deal with specific issues or areas. It promotes a vision for how the district could look in the future and sets out programmes and strategies for tackling some of the problems that affect the quality of life of our residents.
The LDF will guide the shape of the district in the future and will be used to determine all planning applications made to the council. It complements the Community Strategy and provides a spatial dimension to the objectives set out in it.

Ellesmere Port & Neston Borough Council has been working on two key documents of the LDF over the last 12 months. The Core Strategy Issues and Options report was subject to consultation earlier this year but will not now be taken forward because of local government reorganistation. The Central Ellesmere Port Area Action Plan Issues and Options document which was also subject to consultation earlier this year is likely to be taken forward however. This sets out the planning framework for the town centre and the area between the town centre and the M53.
In addition there are a number of Supplementary Planning Documents (SPD) either completed or in preparation. These are part of the Local Development Framework, and clarify or provide additional information relating to specific planning policies. These can be material planning considerations in determining planning applications.
